The new bankruptcy law introduced in '05 was engineered by the banks to force people out of Chapter 7 get rid of all unsecured debt bankruptcy and into Chapter 13 consolidation bankruptcy.

 

That law was written by large mortgage companies and bank lobbyists who maintained to the federal government and the people that our economy was the pinnacle of capitalism and would grow forever , and there was, under these circumstances no reason whatsoever why anyone shouldn't be able to pay all of their bills. Well they were wrong. Look where we are today just here in Northern Virginia.

 

Those Lenders have now borrowed 15 trillion dollars from the American people. Unbelievably, this amounts to $100,000 for each American family--to get them through the same financial crisis that they created.

 

The credit and mortgage meltdown crisis has pulled down millions and millions of people just like you. Responsible people, people who regularly pay their bills and use only the financial instruments offered to them by the large banks for their personal business, relying on the regulators and the federal government to keep it all honest. People who trusted the SYSTEM! Well, the system broke. And Nobody offered you a $100,000 zero interest government loan, did they? How would it have been different to let these large irresponsible banks go under and give the $100,000 to each family. An interesting economical debate.

 

The bankruptcy law, first passed in 1898, is still there. The 2005 changes made the paperwork harder and the regulations trickier, but most people in Northern Virginia can still get the debt relief they need. Bankruptcy still works in Northern Virginia.

 

So what is this new Bankruptcy Law created in 2005?

 

Well this law requires that the court assign a monthly reasonable budget for your debts. Your car, food, housing, clothing etc etc Some of the numbers in that assigned budget, are pretty fair, some are absolutely insane

Here's a great one. Northern Virginia bankruptcy residents are only allowed $230 per month to cover car expenses--gasoline, insurance, car repairs, maintenance, tires, tolls, everything.

For people with long commutes (and by the way residents of Prince William County, Virginia, have the longest average commute of anywhere in the country, outside of New York City), the $230 wont even cover your gas to work even if you drive a prius.

 

However, we know the game, we've played it many times and we can most assuredly get your budget to work and your chapter 7 approved.

 

Trust me, the Banks and Mortgage companies who wrote this new law were looking after their own interests, but in general isn't an economy stronger if the interests of the PEOPLE are served by Government? Here are my problems with the New Bankruptcy Law

 

The 2005 Bankruptcy amendment added a lot of additional code. Doubling the size of the Bankruptcy statutes. Dramatically enhancing the courts ability to deny chapter 7 and force you into a court monitored repayment plan or chapter 13.

 

Your paperwork is a lot harder. Under the old law there was a presumption that you were eligible to file a Chapter 7 bankruptcy if you were broke. But now there is a much stronger burden of proof.

 

There are requirements, hurdles to jump, you have to start by taking two debt management education classes on the internet, you have to save all of your pay stubs for six months and show the court your social security card, your tax forms and bank statements.

 

The people behind the new law sold Congress on the idea that all these requirements and paperwork would make the system more honest. The result--which is what the lobbyists really wanted--is that people who are distracted and worried sick--like you, right now--have all this additional burden to face. They want to break you down, make you give up, force you to make mistakes that they can use to beat you into chapter 13 submission so that the courts can control your finances and give the banks your money.

 

The bank lobbyists wrote the new law with a goal of making it so complicated that you are destined to fail. My job is to force you to succeed. I am good at this.

 

Another thing: There are Investigators from the Justice Department now checking you out, running computer searches, checking out assets in your name, your spouses name, other property, transfers of cash and other assets. It's no joke now to try and hide your assets and do a chapter. Don't try it. It doesn't work. They look at your bank statements and tax forms. The patriot act may help the NSA and CIA to find terrorists but it just might have had a few other side consequences to the good citizens of the United States. This is not the same United States we live in.
